Clear terms before any serious build.

Omerica Studios is a trade name (DBA) of Halal Helper LLC, a New Jersey limited liability company. These public terms explain how Omerica Studios presents its services, pricing, privacy practices, and project boundaries. They are not a replacement for a signed client agreement, master services agreement, statement of work, or attorney-reviewed contract.

This page is not legal advice. It is a plain-English public policy page for Omerica Studios. Every client project should still be governed by a signed proposal, statement of work, master services agreement, or other written contract. If there is a conflict between this page and a signed agreement, the signed agreement controls.

No public webpage can guarantee complete protection from every legal, business, financial, technical, security, or regulatory risk. Clients and Omerica Studios should use written scope, written approvals, documented change requests, and attorney-reviewed contracts for serious engagements.

Website terms of use

This website is provided for general information about Omerica Studios and its services. By using this website, you agree not to misuse it, attempt to break or access systems without permission, copy protected content without permission, submit false or unlawful information, or interfere with normal site operation.

All website content, branding, design, copy, images, and examples are provided for informational and promotional purposes. Omerica Studios may update, remove, or change site content at any time without notice.

Interactive demos, safety, and who may use this site

What the demos are. This site publishes interactive 3D worlds, simulators, dashboards, calculators, and sample applications. They are illustrations of what Omerica Studios can build. They run on sample, synthetic, or anonymized data, they are not live business systems, and no result, number, price, estimate, or output shown in them should be relied on for any real decision.

Flashing, moving light, and photosensitivity. Some pages render animated 3D graphics with camera motion, moving light, reflections, and changing contrast. A small number of people can experience seizures when exposed to flashing lights or visual patterns, including people with no history of seizures or epilepsy. Omerica Studios designs this site to avoid content that flashes more than three times in any one second, the general threshold in WCAG 2.3.1, but makes no guarantee that any page, browser, device, or setting is safe for any particular person. If you or anyone in your household has a seizure disorder or is photosensitive, consult a doctor before using the interactive pages. Stop using the site immediately and consult a doctor if you experience dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, involuntary movement, or convulsions.

Motion discomfort and comfort limits. First-person movement, camera motion, and 3D depth can cause motion sickness, nausea, disorientation, headache, or eye strain. Use these pages seated, in a well-lit room, at a comfortable distance, and take regular breaks. Stop if you begin to feel unwell. Do not use the interactive pages while driving, operating machinery, or doing anything else that requires your attention.

Not intended for children. This website is a business site for business owners. It is not directed to children, it is not designed or marketed for children, and Omerica Studios does not knowingly collect personal information from anyone under 13 years of age, consistent with the Children’s Online Privacy Protection Act. If you believe a child under 13 has provided personal information through this site, contact us and it will be deleted. A child who uses an interactive demo should do so only with adult supervision, and the supervising adult is responsible for that use.

Your responsibility for your own use and for others. Use of this website and its interactive demos is voluntary and at your own choice. You are responsible for your device, your settings, your surroundings, and for anyone you allow to use the site through your device or account, including household members, employees, and guests. Do not use any demo in a way that could put you or anyone else at risk of injury.

No professional advice. Nothing on this site, and nothing produced by any demo, calculator, estimator, or AI feature, is legal, financial, tax, accounting, medical, engineering, employment, insurance, or regulatory advice. Verify anything important with a qualified professional before acting on it.

AI-assisted content. Parts of this website, its demos, and its written content are built or drafted with AI assistance. AI output can be incorrect, incomplete, out of date, or entirely fabricated, and can be confidently wrong. A human reviews published material, but errors can remain. Do not enter confidential, sensitive, personal health, payment, or account information into any demo, input box, or AI feature on this site. See the AI use disclosure for how AI is used in client work.

Third-party sites and tools. Some links and demos point to third-party websites, products, or services that Omerica Studios does not control. Their content, availability, security, pricing, and privacy practices are their own responsibility, not ours, and a link is not an endorsement.

Limits of liability, and what is not limited. The website and its demos are provided as is and as available, without warranty of any kind, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the fullest extent allowed by law, Omerica Studios is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from use of this website or its demos. Nothing in this section limits or excludes liability for personal injury or death caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited. Every provision of this section is intended to be, and is, effective and enforceable in the State of New Jersey; no provision of this page is void, unenforceable, or inapplicable in New Jersey.

Accessibility and comfort settings. If a page’s motion, contrast, or animation causes you difficulty, or your device is set to reduce motion and a page does not respect it, tell us at hello@omericastudios.com and we will address it. See Accessibility.

Service disclaimer

Omerica Studios provides custom software development, websites, web applications, dashboards, workflow automation, client portals, business tooling, and related strategy or implementation services. The exact services, deliverables, timeline, fees, dependencies, and responsibilities for any project must be stated in a written scope or agreement.

Omerica Studios does not guarantee business results, revenue, profit, lead volume, search rankings, conversion rates, platform approval, legal compliance, tax treatment, funding outcomes, or customer behavior. Business outcomes depend on client operations, offer quality, market conditions, traffic, follow-up, pricing, competition, staffing, and other factors outside Omerica Studios' control.

Contracting standards

For professional software work, Omerica Studios aims to use written project documents before work begins. A proper project agreement should define:

  • Scope, deliverables, and what is not included.
  • Project milestones, review points, and acceptance criteria.
  • Payment terms, deposit, late fees, refund limits, and pause rights.
  • Client responsibilities, approvals, access, content, data, and deadlines.
  • Change request process and pricing for out-of-scope work.
  • Ownership, licensing, reusable code, third-party tools, and portfolio rights.
  • Warranty period, support terms, hosting, maintenance, and security responsibilities.
  • Liability limits, indemnity, confidentiality, termination, and dispute process.

No work should be treated as accepted, transferred, supported indefinitely, or included beyond the written scope unless Omerica Studios confirms it in writing.

Pricing, estimates, and scope changes

Prices shown on the website are general starting points, founding-client planning ranges, and non-binding estimates. They are not guaranteed quotes. Final pricing depends on scope, technical complexity, data migration, integrations, deadlines, design depth, testing needs, third-party platforms, security requirements, support expectations, and whether the client provides required content and access on time.

Fixed-price projects are based only on the written scope. New features, changed requirements, additional revisions, delayed client feedback, new integrations, data cleanup, content changes, emergency requests, or work outside the signed scope may require a separate quote, change order, hourly billing, or new agreement.

Hourly work may be used for consulting, troubleshooting, support, maintenance, change requests, technical cleanup, or open-ended tasks that cannot be responsibly scoped as a fixed-price build.

Starter pricing does not automatically include

  • Copywriting, full brand strategy, logo design, or advanced graphic design.
  • Paid hosting, domains, plugins, APIs, stock assets, software subscriptions, or platform fees.
  • Advanced SEO, advertising, social media management, or ongoing marketing campaigns.
  • Ongoing maintenance, monitoring, backups, emergency support, or security services after launch.
  • Large feature changes, new pages, new integrations, or redesigns after approval.
  • Legal, tax, financial, medical, cybersecurity, privacy, or regulated-industry compliance advice.

Client responsibilities

Clients are responsible for providing accurate information, timely feedback, approvals, required access, brand assets, content, data, licenses, third-party account permissions, and any legal or industry-specific requirements that apply to their business.

Clients are responsible for making sure their own business operations, offers, claims, advertising, customer communications, privacy practices, employment practices, regulated industry requirements, and data handling comply with applicable laws and platform rules. Omerica Studios can help implement requested features, but does not replace the client's attorney, accountant, compliance officer, cybersecurity team, or business advisor.

Ownership, intellectual property, and third-party tools

Ownership and licensing are controlled by the signed project agreement. Unless otherwise agreed in writing, Omerica Studios may retain ownership of pre-existing materials, reusable code, internal tools, templates, methods, know-how, design systems, workflows, libraries, and general development techniques used to create client deliverables.

Clients generally receive rights to the final deliverables described in the written scope after full payment, subject to any third-party licenses, platform terms, open-source licenses, hosting rules, stock asset terms, and reusable components described in the agreement.

Third-party services such as hosting providers, analytics platforms, payment processors, email tools, databases, APIs, AI tools, CRMs, app stores, or SaaS platforms are controlled by their own terms, pricing, uptime, security, and policy decisions. Omerica Studios is not responsible for third-party outages, pricing changes, account suspensions, policy changes, API changes, or platform decisions outside its control.

Support, maintenance, security, and warranty limits

Unless a signed agreement says otherwise, ongoing support, hosting, maintenance, backups, security monitoring, feature updates, bug fixes after the warranty period, platform updates, dependency updates, and emergency response are not included automatically after launch.

Software can contain bugs, and websites or applications may be affected by browser changes, platform updates, hosting incidents, user error, third-party failures, malicious activity, or changes requested after launch. Any warranty, support window, or response time must be stated in writing.

Security is a shared responsibility. Clients must protect passwords, accounts, payment tools, customer data, admin access, and third-party systems. Omerica Studios can build reasonable safeguards within scope, but does not guarantee that any website, application, account, or system is immune from attack, downtime, data loss, or unauthorized access.

Privacy notice

Omerica Studios may collect information that visitors submit through contact forms, intake forms, email, or direct communication. This may include name, email address, company name, website URL, project details, budget range, timeline, and other information the visitor chooses to provide.

Omerica Studios uses this information to respond to inquiries, evaluate project fit, prepare proposals, communicate with clients, deliver services, maintain records, and improve business operations. Omerica Studios does not sell personal information to advertisers.

This website is hosted by Netlify, which also receives and stores contact and intake form submissions. Visit statistics are counted first-party on this website’s own infrastructure and record only the address of the page viewed — no cookies are set, no personal information is collected, and visitors are not tracked between pages, sessions, or sites. Other third-party services may be used for email, security, or business operations. Those providers process information according to their own terms and privacy practices.

The client portal, when signed in, also processes account information: the email address and password used to create the account, the display name and any avatar image supplied, and the project, message, file, and invoice records tied to that account. Portal sign-in details are held only for the duration of the browser session and are never stored in the browser's long-term storage.

Visitors should not submit sensitive personal information, protected health information, payment card numbers, passwords, private keys, government ID numbers, or regulated data through the public contact form unless Omerica Studios has provided a secure and appropriate method for doing so.

To request access, correction, or deletion of information you previously submitted, contact Omerica Studios using the email below. Some records may be retained where needed for legitimate business, legal, security, tax, accounting, dispute, or operational purposes.

Portfolio demonstrations are provided for illustration only. Where a real tool contains private, password-protected, client, financial, or operational data, the public portfolio shows a generic version that is anonymized, simplified, or rebuilt with synthetic sample data. Names, numbers, records, and screenshots in those demos are fictional and do not represent real clients, customers, vendors, or business results.

AI use disclosure

Omerica Studios builds software that uses artificial intelligence, and some tools shown or delivered here include AI features such as assistants, chat interfaces, recommendations, summaries, search, classification, or generated text, code, images, or audio.

AI output can be wrong. It can be incomplete, out of date, or confidently mistaken, and it may differ between runs on the same input. Review anything an AI feature produces before you rely on it, and never treat it as legal, medical, financial, tax, accounting, safety, or other professional advice. A person should stay responsible for any decision that carries real consequences.

Where an AI feature is part of a delivered project, the project agreement identifies which providers are used, what data those providers receive, and whether that data may be retained or used for model training by them. Some Omerica Studios tools run entirely on the client's own device or hardware and send nothing to an outside provider. Which applies to a given build is stated in that build's own documentation rather than assumed.

Omerica Studios does not present AI output as human-authored work, and does not claim an AI feature is more accurate, more autonomous, or more capable than it is. If a demonstration is scripted, staged, or uses sample data, it is labelled as such.

This website itself uses one AI provider: the owner-only operations assistant inside the private CEO console is powered by Google's Gemini API. When the owner uses that assistant, the prompt is sent to Google along with a short business snapshot that can include text previously submitted through this site's contact and intake forms (names, business names, service interests, and message text) and internal task and account summaries. Google processes that data as a service provider under its own API terms; Omerica Studios does not use it to train models and caps the assistant's monthly usage. No public page or visitor-facing feature on this site sends anything to an AI provider.

Data retention

Information submitted through the contact or intake forms is kept only as long as it serves a purpose: to answer the enquiry, prepare and deliver work, and keep the business, tax, and legal records that ordinary operation requires. Enquiries that do not become projects are cleared periodically.

Project files, credentials, and client data supplied for a build are held for the life of the engagement and for the period the project agreement specifies afterwards, then deleted or returned. Access credentials a client shares should be rotated by the client when an engagement ends.

Hosting and security logs are kept by the hosting provider under its own retention schedule, typically around thirty days. To ask what is held about you, or to request deletion, use the contact address below.

Dispute resolution

Talk first. Most problems are solved quickly and directly. Email the address below and allow thirty days to resolve the matter before taking any formal step.

If that does not resolve it, any dispute arising out of or relating to this website or these terms is to be resolved by binding individual arbitration administered by JAMS under its rules in effect when the arbitration begins, including its Consumer Arbitration Minimum Standards where they apply, seated in New Jersey or conducted remotely, rather than in court. Either party may still bring an individual claim in small-claims court.

You and Omerica Studios each waive the right to a jury trial and the right to bring or take part in a class, collective, or representative action.

Thirty-day opt-out. You may opt out of this arbitration and class-waiver provision by emailing the address below within thirty days of first accepting these terms, with the subject line "Arbitration opt-out" and your name. Opting out affects nothing else in these terms.

These terms are governed by the laws of the State of New Jersey. For any dispute not subject to arbitration, the state and federal courts of New Jersey have jurisdiction. If any part of this section is found unenforceable, the rest of these terms continues to apply. A signed client agreement, where one exists, governs over this section for work performed under it.

Accessibility

Omerica Studios aims to keep this website usable by everyone, including people who navigate by keyboard, use a screen reader, need larger text, or prefer reduced motion. Accessible practice is treated as part of building well rather than as an afterthought.

Portfolio demonstrations are experimental and vary. Some of them depend on a camera, a microphone, pointer precision, colour perception, or sustained attention, and those will not suit every visitor. Where a demonstration has an accessible alternative, it is offered inside that demonstration.

If any part of this site or a delivered project is difficult to use with your assistive technology, email the address below with the page and the barrier you hit. Reports get a reply and a fix where a fix is possible.
